These terms and conditions apply to the online supply of all goods sold by Kamo Parts to the customer, unless otherwise agreed in writing by the company. These terms and conditions form a binding agreement between the customer and Kamo Parts. Please read the terms and conditions before using the website. PRICES, SPECIFICATIONS AND POLICIES
All prices are in New Zealand Dollars and include GST. Orders from outside New Zealand are not accepted. Kamo Parts reserves the right to update prices and specifications at any time without notice. We endeavour to ensure the prices and specifications of our goods are as accurate and as up to date as possible. We accept no liability should any of the goods be unavailable or if prices differ from those presented on this web site. We will notify you if you purchased goods from us and the pricing or availability has changed. We reserve the right to accept or reject your order for any reason including (without limitation) if the requested product is not available, if there is an error in the price or the product description posted on the site or in your order. If we reject an order placed through the site, then we will endeavour to notify you of that rejection within a reasonable time after you submit your order.
Kamo Parts reserves the right to change or discontinue at any time any aspect or feature of this website. Kamo Parts do not make and hereby disclaim any warranties or representations, express or implied regarding this website and the information on it or the server that makes them are free from viruses or other harmful elements.
FREIGHT AND DELIVERY
Overseas orders (orders from outside New Zealand) are not accepted. Orders will only be despatched to New Zealand North and South Island addresses. All orders are despatched via courier services so we are unable to deliver to post boxes nor offer an ATL (authority to leave) service. Items excluded from freight may include special, bulky, heavy and dangerous goods items such as but not limited to – aerosol cans, batteries, flammable liquids etc. These may incur additional freight fees. Dangerous goods are not available to be delivered to rural delivery addresses. Customers will be notified of delays in supply as soon as information becomes available. Should your order include the previously aforementioned excluded goods, please contact us.
GOODS RETURNS
We will provide a full refund for any product that is returned unopened and in original condition within 14 days. Freight charges are non-refundable unless goods have been incorrectly picked, do not match the website description, are faulty or damaged. All returned goods, excluding faulty and damaged goods may incur a 10% handling charge. The customer must notify Kamo Parts within three days of the delivery of the order if the goods are being returned. Please call our team before returning the goods on 09 435 4050 or e-mail them on [email protected] in the first instance for return instructions. The original invoice copy or number should be quoted with all correspondence. Should this information be unavailable, proof of purchase (e.g. bank/Visa statement) is required.
Goods that have been used or fitted (other than faulty) are not returnable. Unless otherwise stated; all products have a warranty of 12 months from purchase date.
WARRANTY
Goods are warranted free from defective workmanship and material provided that the goods are unmodified in anyway and are used for the purpose intended by the manufacturer. The warranty covers replacement or repair of the product itself.
In some cases, specific product warranties come with the product and may need to be registered to become active. Warranty will not be extended beyond that of the manufacturer’s warranty period or conditions. The warranty is limited to replacing or repairing any defective goods returned to Kamo Parts in accordance with the procedure set out in these terms and conditions provided that Kamo Parts is satisfied that the defects were defects in manufacture.
CONSUMER GUARANTEES ACT
If the goods have been acquired for business purposes, the terms of the Consumer Guarantees Act 1993 shall not apply.
In these circumstances the only warrant offered by Kamo Parts (express or implied, statutory or otherwise) is the manufacturer’s warranty accompanying the goods, and in no event shall the liability for direct or consequential damages exceed the price paid for the goods.
EXCLUSION OF LIABILITY
Kamo Parts and their suppliers or any third party mentioned on the website or website links will not be liable for damages, direct or indirect, general, incidental or consequential and claims for personal injury, loss of profits or damages resulting from the delay, failure, interruption or corruption of any data due to business interruption arising from the customer’s use or inability to use the website and its content, whether based in contract, strict liability or otherwise and whether Kamo Parts is advised of the possibility of such damages. You as the customer acknowledge that in connection with the website, information will be transmitted over local exchange, internet backbone carrier lines and through routers, switches and other devices owned, maintained and serviced by third party local exchange and long distance carriers, internet service providers and others, all of which are beyond the control and jurisdiction of Kamo Parts and its supplier. Kamo Parts therefore assumes no liability for, or relating to the delay, failure, interruption or corruption of any data or other information transmitted in connection with use of this website.
INFORMATION DISCLAIMER
Kamo Parts advises the customer that the content of this website including, text, graphics, images and third party supplier information is for informational purposes only. Kamo Partscan not guarantee or verify the contents of any externally linked websites and users of this website should note that they click on to external sites/links at their own risk. Kamo Parts will not be liable for any damage or implications caused by the visiting of any external links.
RISK AND OWNERSHIP OF GOODS
Risk in the goods shall pass to the customer upon delivery to the customer or to the address specified by the customer. If a carrier is used to effect delivery, delivery to the carrier shall constitute delivery to the customer, and all claims for goods damaged in transit shall be made to the carrier immediately after the delivery of the goods to the customer.
